This Privacy Policy explains how we collect, use, disclose and protect personal data through our website at https://www.ags-studio.com (the "Website"), in compliance with the Personal Data Protection Act 2010 of Malaysia ("PDPA"), as amended by the Personal Data Protection (Amendment) Act 2024.
This Privacy Policy applies only to personal data collected through the Website. Personal data collected in connection with engaged client work is governed by our Master Service Agreement, and personal data collected from on-camera contributors and creative crew is governed by our Contributor Agreement.
1. Personal data we collect
We collect the following limited categories of personal data through the Website:
(a) Inquiry data submitted through our Contact form: your name, email address, phone number (if provided), and the contents of any message you send us.
(b) Standard website data automatically generated by Squarespace (our website platform) when you visit, including session and functional cookies necessary for the Website to operate.
We do not run separate analytics, advertising, retargeting or tracking tools beyond the default cookies set by Squarespace as our website platform.
We do not knowingly collect personal data from individuals under the age of 18 through the Website. If you are under 18, please do not submit personal data without the involvement of a parent or guardian.
2. Purposes of collection and use
We use the personal data we collect for the following purposes only:
(a) to respond to your inquiry, provide information about our services, and discuss potential engagement;
(b) to operate, secure and maintain the Website;
(c) to comply with applicable Malaysian law; and
(d) where you choose to engage us as a Client, to transition the inquiry into the formal engagement process governed by our Master Service Agreement.
We do not use Website inquiry data for marketing, newsletters or unsolicited communications. If you do not engage us, your inquiry data will not be used to contact you for any other purpose.
3. Legal basis
We collect and process your personal data on the basis of your consent, given when you submit the contact form, and (where relevant) on the basis of our legitimate interest in operating and securing the Website.
4. Disclosure of personal data
We do not sell personal data. We may share limited personal data with:
(a) Squarespace, Inc., as our website platform and form processor;
(b) professional advisers (e.g. lawyers, accountants) where reasonably necessary; and
(c) regulatory or governmental authorities where required by Malaysian law or court order.
All such recipients are required to handle personal data in compliance with applicable data protection law.
5. Cross-border data transfers
Our website platform (Squarespace) is operated from outside Malaysia, primarily in the United States. By submitting personal data through the Website, you acknowledge that limited personal data may be transferred to and stored in jurisdictions outside Malaysia. We rely on the relevant exceptions under section 129 of the PDPA, including your consent and the necessity of the transfer for the performance of the requested service. Where applicable, we ensure that adequate protection is in place for such transfers.
6. Retention
We retain Website inquiry data for twelve (12) months from the date of your last contact with us, after which it will be deleted, save where:
(a) you have engaged us as a Client (in which case retention is governed by the Master Service Agreement); or
(b) longer retention is required by law.
7. Your rights under the PDPA
Under the PDPA you have the right to:
(a) request access to personal data we hold about you;
(b) request correction of inaccurate or incomplete personal data;
(c) withdraw consent to our further processing of your personal data (subject to legal and contractual obligations);
(d) request that we limit our processing of your personal data; and
(e) request that we transmit your personal data to another data controller, where technically feasible (data portability under section 43A of the PDPA).

8. Data breach notification
In the event of a personal data breach affecting your personal data, we will notify the Personal Data Protection Commissioner and, where the breach is likely to cause significant harm to you, we will notify you, in accordance with section 12B of the PDPA.
9. Security
We implement reasonable technical and organisational measures to protect personal data against loss, misuse, unauthorised access, disclosure, alteration or destruction. No method of transmission over the internet is, however, completely secure.
10. Third-party links
The Website may link to third-party websites (including our profiles on Instagram, YouTube and LinkedIn). We are not responsible for the privacy practices of those third parties, and we encourage you to review their privacy policies before sharing personal data with them.
11. Updates to this Privacy Policy
We may update this Privacy Policy from time to time. The latest version will always be available on this page with an updated "Effective date".
